Guiding and Outfitting Permitting Criteria
To be permitted as a Southern Ute guide or outfitter, a person must:
- be an enrolled Southern Ute Indian tribal member.
- With Southern Ute Indian Tribal Council approval, the Southern Ute Indian tribal membership requirement may be waived if one of the following criteria is met:
- The guide and outfitter will provide services with the goal of training tribal members to become permitted guides and outfitters and no tribal member has the qualifications or agrees to provide these instructional services.
- There is a demonstrated need for services which tribal member guides and outfitters cannot, or do not wish to, provide.
- be at least 18 years of age. (Tribal members under 18 may be employed under the supervision of a permitted guide or outfitter in the position of laborer, packer, cook, or trainee.)
- never have been convicted of: a) a felony; b) within the last five years, any violation of the Southern Ute Indian Tribal Wildlife Conservation Code totaling 10 or more permit denial/suspension/revocation points, or any Tribal, state or federal fish, wildlife, guide or outfitting violation; or c) within the last five years, a misdemeanor involving dishonesty or fraud.
- sign a release for use in background checks by Southern Ute Indian Tribal Police to verify Item 3.
- sign a waiver of liability holding harmless and agreeing to indemnify the Southern Ute Indian Tribe and the Southern Ute Division of Wildlife Resource Management ("Management Division") and their employees from actions, claims or damages based on the acts or omissions of the guide and outfitter and his employees.
- provide evidence of familiarity with the boundaries Southern Ute Indian Reservation and ability to distinguish among: hunting units, allotments and assignments within hunting units, and tribal and non-tribal lands.
- provide proof of current first aid certification.
- provide proof of a valid hunter safety certificate.
- provide proof of guiding and outfitting insurance with a minimum of $250,000.00 coverage naming the Tribe as an additional insured.
- complete an application form providing all required information and pay any required application fee.
- sign an agreement with the Tribe and pay any fees for services provided on tribal lands which the Tribe may require.
- have a minimum of two years experience hunting or fishing, depending on the service they wish to offer, and/or guiding and outfitting.
- be able to perform the work of a guide and/or outfitter and, for outfitters, provide the necessary and proper equipment.
- provide evidence of a knowledge of the Tribe's Wildlife Conservation Code and wildlife conservation practices. The Management Division will furnish pertinent information upon request.
- demonstrate a willingness to cooperate with the Management Division Enforcement Division, and other guides and outfitters.
- possess knowledge and have the ability to use a guide and outfitting permit to promote his/her guide and outfitting service in an ethical and professional manner.
- provide three references who can attest to the applicant's leadership abilities, responsibility, integrity and hunting/guiding/outfitting experience.
